61. 現在完了時制:「解除する」と、対照的な「terminate」の2用法

2社間での契約終了に関する、法的な契約書ではないが公的な発表という文脈における

「A社とB社は、米国に販売されたホームベーカリーのアフターサービスを委託する契約を2000年の3月に締結したが、2008年5月末日を以って本契約を解除する。」を英訳する場合には、

A and B agreed to terminate as of May 31, 2008 the agreement of commissioning of after services for home bakeries in the United States of America, which agreement was made and entered into between the parties in March 2000.

よりも、

A and B companies have agreed to terminate, as of May 31, 2008, their agreement relating to commissioning of after-sales services for home bakeries sold in the United States of America, an agreement that had been made and entered into between the two parties in March 2000.

の方が適切です。この文は、日本語の現在時制を表すのに、英語では過去時制ではなく現在完了時制を用いる必要があることを示す例です。「have agreed to」と、セクション38で説明した「we are resolved」および「we are in a position to」との間に大きな意味上の違いはありません。全てに共通するテーマは、事案が継続していたという状態です。特筆すべきもう1点は、主節の内容よりも前に発生した従属節の内容を述べるのに、英語では大過去を使用しているということです。

「印刷処理が終了する」を英訳するなら、

The printing process is ended.

ではなく、

The printing process is thereby terminated.

です。この例文は、上記例文で述べられている状況とは正反対で、終了という行為が強調されているため、「terminate」を使うことが重要であり、現在完了時制を使うのは不適切です。「Is ended」という表現は、概して意味が不明瞭すぎるため、避けるのが最善策でしょう。
